2.0 Data Collection
2.1 What Data is Collected?
2.1.1 Visitors and Users
Two types of information are collected from Visitors and Users
- Non-identified and non-identifiable information on Visitors and Users, this could be collected automatically and cannot be used to identify the visitor or user, such as traffic into the website, “click-stream” activity on services, devices used (tablet, Desktop, Phone) etc.
- Individually Identifiable information on visitors and users. These pieces of information (with effort) will identify the individual private or sensitive nature (Personal Information). This information will mainly persist of information that was provided to us in order to contact or/ identify the visitor or user (contact details such as Email, Name, Address, Phone number, Billing details and any other additional information that may be provided). The personal detail will most likely be provided by users of our paid services. Details regarding browsing connected to third-party accounts (such as email, social media account, etc), any scanned identification documents (such as passport etc or other registration documents uploaded to us) corresponds as personal information. Any non-personal information that can be connected or linked to personal information will be regarded as visitors/ users personal information.

2.1.4 Our services are not permitted for children under 18 years of age. Therefore anyone under the age of 18 should not make a user account or provide any personal details to us or through any of our services. Parents and guardians should supervise their children’s activities at all times.
3.1 How is this information collected?
Data we gathered may also be voluntary, for better experience visitors would make a user account that will require Personal Information. This information is gathered and used to identify users, the use of third-party services such as Facebook and Google will also be included.
4.1 Why this information collected?
4.1.1 The data collected mentioned in clause 2.1 are for the following purposes:
- To provide the necessary services
- To develop and improve visitor/ user experience on the website.
- To prove the relevant support and technical difficulties to visitors/ user
- To potentially contact visitors/ user with general or personalized service-related messages or promotions.
- To potentially offer contest or promotions in addition to contact for eligibility, winners, and benefits.
- To create statistical data for the improvement of our service.
- To improve data security to prevent fraud or unlawful practices.
- To contact visitors/users for candidacy.
- To comply with laws and regulations.
4.1.2 User data will be used in section 4.1.1 however additional use of the data will be in the case of:
- To use your personal information to perform a contract or steps leading to a contract with us.
- To comply with relevant legal or regulatory laws.
- To support the legitimate interest that we have as a business (e.g to improve our website service.) under the condition that it constantly respects your privacy rights.
5.1 Where do we store the information collected?
5.1.1 Our visitor’s/ users/ user of user information may be maintained, and processed by Network’s Authorised affiliates. The collected information is stored on an encrypted server provided by a third-party service. The server is based in the United States of America and Europe and therefore will comply with their respective laws.
5.1.2 Network’s affiliates and service providers that store and provide your personal information on our behalf are each contractually committed to keep visitor and user information protected and secured, in accordance with industry standard and regardless of lesser legal requirements which may apply in their jurisdiction.
5.2 Data localisation obligations: If you reside in a jurisdiction that imposes “data localization” or ” data residency” obligations (i.e., requiring that personal information of its residents be kept within the territorial boundaries of such jurisdiction), and this fact comes to our attention, we may maintain your personal information within such territorial boundaries, if we are legally obligated to do so.
You acknowledge that while doing so, we may continent to collect, store and use your personal information elsewhere, including in the United States of America or Europe.
6.1 User of user’s information
6.1.1 We will collect, store and use the information of personal and non personal information of users of users, for the purpose and benefit of the user. For example the use of third-party services such as emails – users will be able to import contacts and such through the use of the website and thus contacts will be stored within our database on the users behalf.
6.1.2 We will therefore serve as a “processor” and not as a “controller” (as both capitalized terms are defined in the E.U General Data Protection Regulation) of user of user information, the user controlling and operating the user website shall be considered the “controllers” of these user of user information and are therefore responsible for complying with all laws and regulations that are relevant, including collection and control of user information, privacy and data protection law of all relevant jurisdictions.

In addition to highlighting the importance of the policies and user of users acknowledgement to them.
6.1.5 IMPORTANT – VISITOR, USER OR CUSTOMER, PLEASE READ THE FOLLOWING:
Networx has no direct relationship with the individual user of user whose personal information it collects, stores and process. If you are a visitor, user or customer of our users, and would like to make any queries regarding your personal information, please contract the USERS directly. The User is the “controller” of your information and therefore we cannot take action. Any request regarding your personal information can be requested to us and will be dealt with in 30 days unless requested otherwise by the user.
7.1 Job applications
7.1.1 We welcome all job applicants to an open position that may be available. By sending details and CV to us will mean the applicant acknowledges the terms and conditions. We understand privacy and discretion of our applicants are important and will be respected, and are committed to keep applicants information private and sole use of the information will be used by Networx internal recruitment process.
8.1 Sharing information with third parties.
8.1.1 Networx will have a series of third-party services to enhance or complement our services for peak performance. Third parties such as (but not limited to) hosting and server co-location services, communication and content delivery networks, data and cyber securities service. Such third parties may receive or otherwise have access to our visitors and users personal information depending on each of their roles and purpose in facilitating and improving our service.
8.2 Where local data protection laws are applicable Networx may disclose or otherwise allow others access to your personal information pursuant to legal request, such as subpoena, legal proceedings and search warrant or court order, anything compliance to applicable laws. If we have good faith belief that law requires us to so with or without notifying the recipient.
8.3 Networx may share your personal information with other if we believe in good faith that this will help protect the rights, property or personal safety of Networx. This includes the personal information of User, Users of Users or any member of the general public, ith or without notifying the recipient
8.4 Our services will include several social media features and widgets, single sign-on features such as “facebook connect” or “google sign in”, the “facebook like”, “share this” button and other social media interactive mini-programme (“social media features”). These social media features may collect information such as your IP address or which page you are visiting on our website and may set cookies to enable them to function properly. Social media features are either hosted by a third party or hosted directly on our services. please not that your interaction with these third parties “social media features” are governed by their policies an not ours.
8.5 Our services may enable you to share your personal information with third parties directly, such as via page framing techniques to serve content to or from third-party service or other parties, while preserving the look and feel of our website and services “Frames”. Please note that if you choose to interact or share any personal information via such frames, you are in fact providing it to these third parties and not to us, and such interaction and sharing too are governed by third parties’ policies and not ours.
8.7.1 API (application programming interface) by installing our apps or any third party apps you also allow the provider of that app access of certain non-personal and personal information regarding you and/or user of user. Such information includes (but not limited to) contact details, messages, business application and certain activities on the service and/or user website which are stored and accessible via your user account.
8.7.2 To prevent the collection or sharing of personal information via the API you may either avoid installing apps to your user website, revoke the permission granted to apps that has been installed, or uninstall the app. Although previously installed apps may still contain information that was collected prior to the un-installation. Any request for removing the information can only be done directly from the respective party.
9.1 Cookies and other tracking technologies
9.1.1 Networx with its marketing, analytics and technology partners, uses specific monitoring and tracking technologies (examples includes; cookies, beacons, pixels, tags, and scripts). These technologies are used to help us to maintain and provide improved services for a better experience for our visitors, users, and users of users.
9.1.2 Third-parties placing cookies and.or utilizing other tracking technologies through ourselves may have their own policies regarding how they collect and store information. Their practices are not covered by our privacy policies and we do not have any control over them.
9.2.1 Cookies, a small data file must be downloaded and stored on your device. By default, we use several persistent cookies for purposes of sessions and user authentication, security, keeping the user’s preference, connection stability monitoring performance of our service and marketing campaigns and generally providing and improving our services.
9.2.2 If visitors, users and user of users would want to delete or black any cookies, please refer to the help and support area of your internet browser for instructions on how to find the file or directory that stores cookies. further information on deleting or controlling cookies is also available at www.aboutcookie.org. (please note that this website is not provided by Networx and therefore not be liable for the responsibility of the website.) In addition please be aware, deleting our cookies or disabling future cookies or tracking technologies may stop you from accessing certain areas or features of our services, or may otherwise negatively impact your user experience.
9.3 Networx and certain third party services may employ a software technology called “clear gifs” (also known as web beacons) are used with cookies to help website operators understand how visitors interact with their websites. This will enable us to improve our service by analyzing the effectiveness and performance. Clear Gifs are tiny graphic with a unique identifier, similarly to cookies but however are stored on our websites, unlike cookies which are stored on visitors, users, and user of user devices.
9.4 Networx and certain third party services may also employ certain tracking technologies known as “Flash cookies” and “HTML5” these are mainly for advertisement purposes. If visitors, users, and user of users wish to avoid this, we would allow them to install their own management tools for removing or blocking such technologies on their own devices. We will not take any responsibility for visitors, users, or users of users, as they are done at their own risk.
9.5 Networx and certain third party services may use ad networks that may display advertising on our website or applications related to us. These parties may use certain tracking technologies to collect certain information about your activities on the service and different third party to provide a relatable advertisement that may peak your interest and/or you may benefit from. You may opt out of receiving targeted ads from certain advertisers, however, this does not mean you will stop receiving ads, it will simply display generic ads.
9.6 Networx may receive information about you from other sources, I.E links from a third-party website which has been transferred to us. This also includes a publicly available database or third parties from whom we have purchased data and combine this data with information we already have about the visitor, user, and user of user. This enables us to update, expand and analyze our records, to identify new customers and provide products and services that may be of interest to you.
10.1.1 We may use your personal information to contact you with promotional messages by e-mail, text message, direct messages, marketing calls and similar form of communication that are available to us or our partners on behalf of Networx. If you wish to opt out of promotional offers and potential future benefits you may notify Networx at any time and “unsubscribe” or instructions to stop within the promotional offer you may receive (where applicable). Please Note that we try and limit the promotional content to quality genuine adverts that we believe will interest you with benefits and relevance to you based on your information.
10.2 Networx may also contact you with important information about our services, one example; (but not limited to) we may send you a notice through any means that are available to us if our service is temporarily unavailable or under maintenance. Replying to your support ticket or email, send you reminders or warnings regarding upcoming or overdue payments on subscriptions. Abuse or non-compliant to our terms and condition regarding the website or service will also warrant communication between Networx and recipient(s). Some information is too important to opt out, an example includes (not limited to) Services and Billing messages. Networx will also reserve the right to ban accounts along with its personal information if we believe it to be of misconduct and sinister behavior.
11.1 Your Rights in Relation to your Personal Information
11.1.1 It is important to know you have control over your personal information. That is why you will have access to update, amend, delete or limit the use of your personal information, this also means you are responsible for opening a way for Networx to communicate with you.
11.2 we will therefore not be responsible if you provide us with the wrong information. Any prizes and benefits will be null and void if the information provided to Networx is false. This is FRAUD and we WILL NOT entertain the notion.
11.3 Before disclosing requested personal information, we may ask you for additional information in order to confirm your identity. This is for security purposes and we will reserve the right to charge a fee where permitted by law. For example, if your request is unfounded or excessive. You will have the right to file a complaint with your local supervisory authority for data protection, however, we urge you to contact us first as we will be compliant at a reasonable cause. Please Note, if Network suspect fraudulent behaviour we will reserve the right to non-disclosure of personal information and lock user accounts to protect the client until contacted by officials.
11.4 Networx will make all reasonable efforts to honour your request as soon as possible (unless we require more information to fulfil that request). Subject to legal and other permissible considerations. you may also correct, update or remove certain parts of such personal information by yourself. Please be aware that permanently deleting your Networx account will delete ALL your personal information on the Networx database. After completing this process you can no longer use any of Networx’s services, and all deleted data cannot be retrieved. If you contact Networx in the future post deletion of your account the system will not recognise your account and support agents will not be able to locate the deleted accounts.
12.1 Data Retention
12.2 We will also to continue to retain such personal information even after you deactivated your user account and cease to use any particular service as reasonably necessary to comply with our legal obligations to resolve disputes regarding our user and/or user of user, to prevent fraud and abuse so we can enforce our agreements and protect our legitimate interest.
13.1 Networx’s has the appropriate security to protect the personal information you have used when making an account, this also includes physical and electronic and procedural measures amongst other methods of security. We also offer HTTPS secure access to the majority of our web service; paying online, we secure your personal details such as credit card number, through to our purchase form is protected by industry standard SSL/TLS encrypted connection and thoroughly maintain a PCI DSS (Payment Card Industry Data Security Standards). We also check our online system and look for possible weak spots, vulnerable area and likelihood of an attack, then find a countermeasure to make to further enhance the security of our service and protect the private information of our users.
13.2 We hope users will understand we have taken every precaution to prevent a breach of security, we cannot and do not guarantee the absolute protection and security of your personal information, your user of user’s personal information or any other user content uploaded.
13.3 We urge users to set a strong password for your user account and user website (if applicable) and avoid sharing with us or anyone else with sensitive information that you believe if disclosed would lead to cause you any amount of harm. When communicating with anyone with either e-mail, instant message or even support ticket (if sent with the incorrect setting) please note they are not recognized as secure forms of communication and we advise you to not share any private personal information through these channels.
14.1 Public Forums and user content
14.1.1 Some of our services may include accessible blogs, communities and support forums. Please note that any information you provide in any such areas may be read, collected and, used others who access them. if you wish to remove any of your personal information from these public channels then you may request to do so at the directed email address (which may refer to either the host or admin of the forums). In some cases, we may not be able to remove your personal information, for instance, if you used a third party application to post a comment (example facebook social plugins, Twitter social plugins etc.) and must, therefore, contact the third party to request removal of the content you posted. In any case, we strongly advise against posting any information you do not wish to publicize on these platforms and understand the right means to remove your post if you wish to do so. Post information at your own risk.
14.2 We have placed the appropriate security measure in place to protect your personal information. On the other hand, we cannot control the action of other users or members of the public who may access your content. We are therefore not responsible for the circumvention of any privacy settings or security measures. To use our service you understand and acknowledge that even after content may be removed by you or us, copies of user content may remain viewable in cached and archived pages or if any third party have copies or stored user content.
15.1 Contacting US
Our website gives the option to view prices exclusive or inclusive of VAT. We charge VAT on all applicable products.
After placing an order, NetworX will send an Order Confirmation to you. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to buy a product. All orders are subject to acceptance and we will confirm such acceptance by sending an email to you confirming our acceptance of your order and dispatch. The contract between us will be formed when we send the Dispatch Email.
The contract will relate only to those Products in the Dispatch Email. We cannot be obliged to supply any Products which may have been part of your order but have not yet been confirmed by the Dispatch Email.
All descriptions, photographs and advertising are solely to provide an idea of the products they describe. While we take every care with our descriptions, errors may occur, and are excepted from the contract if very minor. Images are for illustrative purposes only.
Payment can be made by credit or debit card, cash, PayPal , Amazon Payments, Apple & Google Pay. We cannot dispatch any Products until we have cleared funds. If you are using PayPal as your payment method we reserve the right not to ship to unconfirmed addresses.
If payment is made by credit or debit card, we reserve the right to make delivery to the statement address of the cardholder.
While we try and ensure all prices on our website are accurate, errors may very occasionally occur. If we do discover an error in the price of a Product ordered before dispatch we will inform you as soon as possible and give the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If the order is cancelled under this clause and you have already paid for the Product, you will receive a full refund.
If the pricing error is obvious and could have reasonably been recognised as a mis-pricing, we will be under no obligation to provide the Product even after despatch.
You may cancel your purchase at any time within 14 days of receipt and we will give you a refund in accordance with our Returns Policy. Some items are not covered by this clause; please refer to our Returns Policy for further details. You must inform NetworX in writing and return the Products to us immediately in the same condition you received them, at your own cost and risk. We recommend you follow our packaging guidelines and return via recorded delivery as we cannot be liable for goods damaged or lost in transit to us.
If a Product is faulty or delivered in error then please refer to our Returns Policy.
You must obtain a RMA number from NetworX and quote this when returning the goods. You will be credited with the current price of goods at time of payment.
Any delivery date stated is a warranty by NetworX to use reasonable endeavours to effect delivery by that date. No liability will be accepted by NetworX for failure to meet a stated delivery date, If a product is delivered to you in error and is not what you ordered, then you must contact Customer Services.
Products supplied by NetworX are delivered at the risk of NetworX. Customers must make a claim for damage or loss of the goods in writing: –
If a Product is damaged, within 5 days of delivery; and
If a Product has been lost or is short, within 5 days of delivery.
A claim for loss or damage may not be allowed if the you claim outside the above time limit.
If within 12 months of being delivered a defect in any Product is discovered which is directly due to faulty goods then contact the manufacturer directly, failing an RMA request NetworX shall at its option repair or replace the Product. If a Product is found to be faulty within 14 days then you have the option to a refund for the faulty product.
You should return the Product in its original packaging to NetworX . Prior authorisation must be obtained for any returns by contacting NetworX customer services and obtaining a RMA number, which must be quoted in any correspondence. You must back up all data as we cannot guarantee your data during repairs or testing.
All returns must comprise of only the defective Product.
If any item is returned which is found not to be faulty by our technicians, then a charge will be made for return carriage insurance and administration.
This clause does not affect your statutory rights.
Limitation of Liability
We warrant to you that any Product purchased from us through our site is of satisfactory quality and reasonably fit for all the purposes for which it was listed. This warranty does not apply to any defect in the Product arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, if you use the Product in a way that we do not recommend, your failure to follow instructions, or any alterations or repair you carry out without our prior written approval.
Our liability for losses you suffer as a result of us breaching this agreement is strictly limited to the purchase price of the Product you purchased.
This does not include or limit in any way our liability:
for death or personal injury caused by our negligence;
under section 2(3) of the Consumer Protection Act 1987;
for fraud or fraudulent misrepresentation;
for any deliberate breaches of these Terms by us that would entitle you to terminate the contract between us; or
for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
We are not responsible for any indirect or consequential losses which happen as a side effect of the main loss or damage and even if such losses result from a deliberate breach of this Contract by us that would entitle you to terminate the Contract between us, including but not limited to:
loss of income or revenue;
loss of business;
loss of profits or contracts;
loss of anticipated savings;
loss of data, or
Waste of management or office time however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this clause shall not prevent claims for loss of or damage to your tangible property that fall within the terms, or any other claims for direct financial loss that are not excluded by any of the prior clauses
Uncontrollable Events and Delays
In case of delays caused by circumstances beyond the control of NetworX or its suppliers, NetworX shall have the right to either suspend delivery or to cancel the contract without liability.
Examples of Uncontrollable Events are (by way of example and not limited to) natural disasters, flood, strike, lockout, riot, revolution, war, epidemic, working difficulties, transportation difficulties, fire, and failure of suppliers or official regulations.
Variation of Terms and Conditions
From time to time we may need to update these terms and conditions to reflect changes in legislation, the marketplace or company policy. The contract will be subject to those terms and conditions in force at the time of the formation of the contact – ie on the date of the Dispatch Email.
